By registering for the Retreat, I (the “Participant”) acknowledge and agree that the following terms & conditions shall apply. Marta Koch (the “Organiser”) also acknowledge and agree that by confirming the Participant’s registration the following terms & conditions shall apply.

1. Main Obligations

The Organiser shall offer and conduct the retreat (including accommodation and meals) essentially as described on this website (the “Retreat”). The Organiser may change the schedule, individual parts of the Retreat and the contents of activities if, in their discretion, this is necessary and does not materially alter the kind and quality of the Retreat, or if this is required for reasons of health, prevention of accidents, weather conditions or other compelling reasons. Accommodation and meals will be provided by Domaine de Mournac (the “Hosting Facility”).

The Participant will pay the participation fee (the “Fee”) as detailed on this website, no later than by the dates stated (the “due dates”). If the Fee has not been received on or before the relevant due dates, the Organiser may exclude the Participant from participation in the Retreat or may charge a late payment surcharge of EUR 1 for each day.

2. Cancellation

If the Participant cancels the registration no later than 3 months before the first day of the Retreat, then no Fee other than an administration charge of EUR 30,00 and card processing fees will be charged, and in case the Participant has already made payment, the full Fee (minus the administration charge of EUR 30,00 and card processing fees) will be reimbursed. If the Participant cancels the registration no later than 2 month before the first day of the Retreat, then 50% of the Fee will be charged, and in case the Participant has already made payment, the remainder will be reimbursed. If the Participant cancels the registration less than 2 months before the first day of the Retreat, then the full Fee will be charged.

The Organiser reserves the right to cancel the retreat under any circumstances, in which case any part of the Fee already paid by the Participant will be refunded within 14 working days from the cancellation notification.

3. Health & Fitness

I, the Participant, confirm that I am in proper physical condition to participate in the Retreat and all its physical activities and am aware that participation could, in some circumstances, result in physical injury, serious physical injury or death in extreme cases.

I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured.

I understand that yoga is not a substitute for medical attention, examination, diagnosis, or treatment. I should consult a physician prior to beginning any activity program, including yoga.

I recognize that it is my responsibility to notify the Organiser of any serious illness or injury before the retreat. I will not perform any postures to the extent of strain or pain.

I understand that I will bring proper attire for the activities planned, and I will at all times follow the advice and instructions by the Organiser. I understand that the Organiser may exclude me from participating in individual or all activities if, in their sole discretion, they deem that I am not fit for such activity.

4. Liability

The Organiser will be liable for fulfilling their main obligations, i.e. to conduct the Retreat as described on this website. However, this liability shall be limited to the amount of the Fee, and shall not include liability for any indirect or consequential damages.

Other than expressly provided herein, the Organiser and the Hosting Facility are not liable for any damages suffered by the Participant. This includes, in particular, any lost expenses or damages, whether direct or consequential, incurred by the Participant as a result of a cancellation of the Retreat (including but not limited to airline tickets, accommodation bookings or any other expenses).

However, nothing in these terms & conditions shall limit the Organiser’s or the Hosting Facility’s liability for death, physical injury and health, and for any intentional or grossly negligent acts.

The Participant is obliged to contribute to preventing and mitigating any damages by informing the Organiser about any health or fitness issues, allergies or other problems, and by taking all reasonable steps to prevent and mitigate any damages suffered.
